These Terms of Service ("Terms") govern your access to and use of the 3D Ture platform and website at https://3dture.com ("3D Ture", the "Service"), operated by 3D Ture ("we", "us", "our"), established in Latvia, European Union. By accessing or using the Service, or by accepting an account, you agree to these Terms. If you use the Service on behalf of an organisation, you represent that you are authorised to accept these Terms on its behalf, and "you" refers to that organisation. If you do not agree, do not use the Service. These Terms should be read together with our Privacy Policy.

1.Acceptance of these Terms

By being granted an account, accessing, or using the Service, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated by reference. If you are entering into these Terms on behalf of a company or other legal entity, you represent that you have the authority to bind that entity.

2.The Service & closed-pool / beta status

3D Ture is a platform that transforms spatial scans (such as point-cloud files, panoramas and images) into hosted, interactive 3D virtual tours. It also offers optional AI-assisted 3D asset generation and branded transactional email for business tenants.

The Service is currently offered on a closed, invitation-only pilot/beta basis. Access is limited to allowlisted staff and pilot accounts and is not open to the general public. Features may change, be added, or be removed, and the Service may contain defects or be interrupted. We may modify, suspend, or discontinue any part of the Service at any time. Because the Service is in beta, you should keep your own copies of any original scans and important content.

The Service is currently provided free of charge during the pilot/beta. We may introduce fees in the future with prior notice; continued use after any fees take effect will require your agreement to the applicable pricing.

3.Eligibility & accounts

  • Accounts are created by an administrator; there is no public self-registration. Access is further restricted to email addresses on our allowlist.
  • You must be at least 18 years old (or the age of majority in your jurisdiction) and capable of forming a binding contract. The Service is a business tool and is not directed at children.
  • You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us promptly at support@3dture.com if you suspect unauthorised use.
  • You must provide accurate information and must not share your account or attempt to access the Service through anyone else's account or outside the access you have been granted.

4.Acceptable use

You agree not to, and not to permit anyone else to:

  • upload or share content that is unlawful, infringing, defamatory, or that violates the intellectual-property, privacy, or other rights of any person;
  • upload scans of places, objects, or people that you do not have the necessary rights, permissions, or legal basis to capture, upload, and process — you are responsible for obtaining any required consents;
  • attempt to bypass, disable, or interfere with the allowlist, authentication, access controls, or other security features of the Service;
  • reverse-engineer, decompile, or attempt to extract source code, except to the extent this restriction is prohibited by applicable law;
  • upload malware or use the Service to distribute harmful code;
  • overload, disrupt, or impair the Service or the infrastructure it runs on, including through excessive automated requests;
  • use the Service to build a competing product, or resell or sublicense access without our written permission;
  • use the Service in violation of any applicable law or regulation.

We may investigate suspected violations and take appropriate action, including removing content and suspending access.

5.Your content & the licence you grant us

You own your content. You retain all ownership of the scans, images, models, project data, and other materials you upload to or create with the Service ("User Content"). We do not claim ownership of your User Content.

Licence to operate the Service. To provide the Service to you and to those you choose to share with, you grant us a limited, non-exclusive, worldwide, royalty-free licence to host, store, copy, process, transform (for example, to convert scans into 3D tours and derived assets), transmit, and display your User Content solely for the purpose of providing, maintaining, securing, and improving the Service for you. This base licence does not include using your scans to train AI models or to include them in commercial datasets or research — those uses happen only under the separate, opt-in consent levels described below. This licence ends when you delete the relevant User Content or your account, except that: (a) we may retain copies as described in our Privacy Policy and as required by law or our storage lifecycle; and (b) copies may persist in backups, versioned storage, or content-delivery-network caches for a limited period.

AI training and commercial use are separate and opt-in. We will only use your uploaded scans to train or improve our AI models, or include them in commercial datasets or research, if you actively select the corresponding consent level for that scan (see below). The default is "Processing Only", which permits neither.

Public demo. We will feature one of your projects as a public demonstration on our marketing website only with your prior agreement, and you can ask us to stop featuring it at any time.

Your responsibility. You represent that you have all rights necessary to upload your User Content and to grant the licence above, and that your User Content and its use through the Service do not violate any law or third-party right. Where a scan may capture other people or their personal information, you are responsible for having a lawful basis and for informing them as required by law.

7.Third-party services (Google & Meshy BYOK)

The Service integrates optional third-party services. Your use of them is subject to those providers' own terms and privacy policies, and we are not responsible for third-party services.

  • Google (Branded-Email "Connect Google"). An administrator may connect a Google account to set an email-forwarding target. We request only the `openid email` scope and read only the verified email address; see the "Google user data & Limited Use" section of our Privacy Policy. Your use of Google is subject to Google's terms.
  • Meshy (Bring-Your-Own-Key AI generation). Optional AI text-to-3D generation runs under your own Meshy account and API key. You are solely responsible for your Meshy account, your API key, any credits or charges, and for complying with Meshy's terms of service and acceptable-use policies. We do not proxy, sponsor, or guarantee Meshy's service, and Meshy's processing of your prompts is governed by your agreement with Meshy. We are not liable for the availability, output, accuracy, or acts of any third-party provider.

8.Intellectual property

The Service, including its software, design, text, graphics, and all related intellectual-property rights (excluding your User Content), is owned by us or our licensors and is protected by applicable laws. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable right to access and use the Service for its intended purpose during the term of your access. No rights are granted except as expressly stated. "3D Ture" and our logos are our marks and may not be used without our prior written permission.

9.Disclaimers (beta / "as is")

The Service is provided on a closed pilot/beta basis, "AS IS" and "AS AVAILABLE", without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement, to the maximum extent permitted by law.

We do not warrant that the Service will be uninterrupted, error-free, secure, or that processing will always succeed or produce accurate results. Scan processing and AI generation are inherently imperfect. You are responsible for keeping your own backups of original scans and important content. Nothing in this section limits any warranty or right that cannot be excluded under mandatory applicable law (including EU consumer-protection law where it applies to you).

10.Limitation of liability

To the maximum extent permitted by applicable law:

  • We will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business, arising out of or relating to the Service, even if advised of the possibility of such damages.
  • Our total aggregate liability arising out of or relating to the Service or these Terms will not exceed the greater of (a) the amounts you paid us for the Service in the twelve (12) months preceding the event giving rise to the claim, or (b) EUR 100.

We do not exclude or limit liability where it would be unlawful to do so — including liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any liability that cannot be excluded under mandatory applicable law (including your non-waivable statutory rights and our obligations under the GDPR).

11.Indemnity

To the extent permitted by applicable law, you agree to indemnify and hold us harmless from and against third-party claims, damages, and reasonable costs (including reasonable legal fees) arising out of: (a) your User Content; (b) your use of the Service in breach of these Terms; or (c) your violation of any law or third-party right, including uploading scans you were not entitled to upload. We will notify you of any such claim and may participate in its defence; you will not settle any claim in a way that imposes obligations on us without our prior written consent.

12.Suspension & termination

We may suspend or terminate your access to the Service, in whole or in part, at any time — including if you breach these Terms, if your account is removed from the allowlist, if required by law, or to protect the Service or other users. Because access is invitation-only, it may also end when a pilot or engagement concludes.

You may stop using the Service at any time; contact support@3dture.com regarding account closure and deletion of your data. On termination, the licences granted to each party end, subject to the retention practices described in our Privacy Policy. Provisions that by their nature should survive termination (including ownership, disclaimers, limitation of liability, indemnity, and governing law) will survive.

13.General

Severability. If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full force and effect, and the invalid provision will be enforced to the maximum extent permitted by law.

Entire agreement. These Terms, together with our Privacy Policy and any separate pilot or written agreement between us, constitute the entire agreement between you and us regarding the Service and supersede any prior understandings on that subject.

Assignment. We may assign or transfer these Terms, in whole or in part, to an affiliate or in connection with a merger, acquisition, reorganisation, or sale of assets. You may not assign your rights or obligations under these Terms without our prior written consent. These Terms bind and benefit the parties' permitted successors and assigns.

No waiver. Our failure to enforce any right or provision of these Terms is not a waiver of that right or provision.

Force majeure. We are not liable for any delay or failure to perform caused by events beyond our reasonable control, including acts of God, natural disasters, outages of infrastructure or third-party providers, network failures, or governmental actions.

14.Changes to these Terms

We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date and, where appropriate, notify you. Your continued use of the Service after the changes take effect constitutes acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the Service.

15.Governing law & disputes

These Terms and any dispute arising out of or in connection with them or the Service are governed by the laws of Latvia and applicable European Union law, without regard to conflict-of-law rules. Subject to any mandatory rights you have as a consumer to bring proceedings in your country of residence, the courts of Rīga, Latvia will have exclusive jurisdiction.

Nothing in these Terms affects your mandatory statutory rights or your right to lodge a complaint with a data-protection supervisory authority as described in our Privacy Policy.
